Terms of use

These terms cover the use of webshopxl.com. WebshopXL is the trade name of Erik Waal, reachable at info@webshopxl.com. A chamber of commerce number and a visiting address will be published on About WebshopXL once that registration can be published.

What the site is

WebshopXL compares offers from webshops. We show a delivery day, a cutoff, a total price and an indication of how often a shop hits the day shown. We do not sell the product, we do not take the payment and we do not ship the parcel.

You contract with the shop you click through to. That shop is your counterparty for delivery, withdrawal, warranty and complaints about the goods. Our comparison does not replace the information on the shop's own site. Check the day and the price there before you pay.

Data that comes from shops

Cutoffs, stock, prices and shipping rules come from the shop, from a feed, or from a sample set we filled ourselves. Sample products are marked where the measurement makes that distinction: they do not count toward the gate of 200 shipments.

A date on our screen is the result of the rules at that moment. The shop can change the cutoff afterwards, sell out, or treat a holiday differently. We update the rules as fast as we can. We do not promise that every rule matches the warehouse every minute.

Ranking

The default order follows the delivery day and reliability. The formula is on How we measure. There is no paid place that changes that order. If a paid mention exists later, it will be labelled and the score stays untouched. That is also written in the roadmap.

You may sort another way, on fastest, on cutoff, on reviews or on distance. That is your choice at that moment. It does not change the underlying score.

A webshop account

We create a shop login in XLadmin. You keep the password to yourself. We store a hash, not the password. The account shows the documentation and the rules that were set. Changing the rules goes through us, so there is one source.

You only supply data you are allowed to supply, such as a feed of your own catalogue. A feed replaces the sample offers for that shop.

Complaint and opt-out

If you are a shop and a cutoff, a score or a hidden listing is wrong, email info@webshopxl.com. We confirm receipt and reply on the substance within 15 days. If that fails, we say when it will succeed. This path exists because the P2B Regulation asks for a complaint route for business users.

The form on Complaint and Opt-out shows, in this version, what that path will look like. The form does not store your message on our server and does not send mail. Use the email address if you want a person to read it.

If you want a shop removed, and you can show that you may decide for that domain, we take the listing down. We ask for the smallest proof that fits, for example mail from the domain.

Use of the site

You may use the site to pick a shop. You may link to it. You may not use it to guess accounts, intercept someone else's feed, or send so many requests that the server becomes slow for others.

Texts, the name WebshopXL and the layout of the screen are ours, where no third-party rights apply. Shop names, product titles and prices stay with those shops.

Liability

If something goes wrong with the product, the payment or the delivery, that is between you and the shop.

For a mistake of ours, for example a date that was wrong on screen because of a bug in the calculation, we remain liable as the law requires. We limit nothing in case of intent or deliberate recklessness. Otherwise liability is limited to direct damage, with a maximum of 500 euro per event. Towards a consumer that cap applies only as far as mandatory law allows it.

Law

Dutch law applies. That does not take away the protection you keep as a consumer under the law of your home country. A dispute goes to the competent court in the Netherlands, unless a mandatory rule points to another court.

The date at the top is the version that applies. We change the date when the text changes. The Dutch text wins over the English, French and German translations.
